Holiday possession is the same whether a non-custodial parent lives within or without 100 miles of the other parent. Thanksgiving and Spring Break are alternated between parents, in odd and even years. The Christmas vacation is spilt relatively in half between parents, again rotating in odd and even years, with the parent not having Thanksgiving in that year enjoying the period that includes Christmas day.
Summer possession depends on the distance the parents live apart. If the parents live less than 100 miles from one another, the non-custodial parent is afforded thirty days of extended summer possession. If the parents live more than 100 miles apart, the period is extended to 42 days. There are more limited provisions through which the custodial parent can designate summer possession time as well, during which the weekend possession of the non-custodial parent is interrupted.

There are many details to be determined, ranging from cost considerations following a move by one parent that includes the travel expenses of the other, pick-up and drop-offs, rights of first refusal for a parent when the other parent cannot exercise physical possession – the list could be endless. These are, however, beyond the scope of this overview.

As to the decision whether to engage Tom Carnes in a case that involves child issues, the Tom believes that children are the most important people in any divorce.
