Tom Carnes has, throughout his career, been involved in litigating disputes arising in the context of construction and mining.
As an example, Tom participated on a team that successfully defended a concrete subcontractor against claims of defective
workmanship in a multi-million dollar case involving literally miles of concrete at a grocery distribution facility.
With regard to mining, Tom participated on teams representing an owner of a Texas lignite mine in two price redetermination proceedings
with its captive utility customer. The first dispute was arbitrated successfully, and a price increase avoided. The second dispute was
resolved by agreement prior to arbitration. These are, of course, merely two examples of particularly large mining and construction
disputes that Tom has worked on in the course of many years. There are, of course, other more mundane examples; mundane, that is,
to everyone except the parties, for whom every such dispute is vitally important.
